1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Bhabhua P.S. Case no. 595 of 2024 registered under sections 316(2) and 318(4) of the Bharatiya Nyaya Sanhita,

3. As per the prosecution case, the informant states that for incorrect reasons, he did not succeed in the Teachers Recruitment Exam (TRE)-1 conducted by the Bihar Public Service Commission. It is further stated that one of the student leaders ie the petitioner herein invited the informant and other similarly situated students through his recording on Youtube to join as petitioners in a case. Accepting the said invitation, the

No.73301 of 2024(2) dt.11-11-2024 2/3 informant deposited a sum of Rs.3000/- on 3.1.2024 in the account directed, however, it subsequently transpired that neither the informant was made a petitioner in the case nor his amount returned. The informant has been cheated of his amount by the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. It is submitted those students who had given their vakalatnama with the required expense had joined and filed CWJC no.2337 of 2024. The allegations levelled by the informant are false and concocted. The petitioner has no criminal antecedent.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State and learned counsel for the informant. Learned counsel for the informant submits that large number of students including the petitioner herein have been cheated by this petitioner and thus the application for anticipatory bail be rejected.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R. together with the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned

Case no. 595 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua.
