The petitioner seeks bail in a case registered for offences punishable under Sections 30 and 32 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 10.875 litres foreign liquor was recovered from a sack. which was being carried by the petitioner. It is further contended that the petitioner has falsely been implicated in this case due to village politics. Petitioner claims that he is having clean antecedent and is in custody since 13.08.2018.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released

Patna High Court Cr.Misc. No.59321 of 2018(2) dt.06-10-2018 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge, Excise Act in connection with Bachwara P.S. Case No. 128/2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
