JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-09-2018 By order dated 05.04.2018, the petitioner was granted bail in Cr. Misc. No. 16920 of 2018 subject to the condition of the petitioner surrendering before the court below within a period of four weeks from the date of receipt/production of a copy of the order, when the petitioner was directed to be released on bail on his furnishing bonds in the sum of Rs. 10,000 (Ten Thousand) with two sureties of like amount.

The petitioner could not surrender before the court below on time. Hence, the present application for extension of time to enable the petitioner to surrender before the court below.

For the reasons stated in the application, the order dated 05.04.2018 is modified to the extent that

No.56963 of 2018(2) dt.14-09-2018 2/2 the petitioner would now surrender before the court below within a period of four weeks from today and on his so surrendering, he shall be released on bail on his furnishing bonds in the sum of Rs. 10,000 (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Darbhanga in connection with Kamtaul P.S. Case No. 60 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

The other conditions imposed in the order dated 05.04.2018 shall however subsist.

With the aforesaid modification in the order dated 05.04.2018, the application stands allowed. (Ashutosh Kumar, J) krishna/- U T
