====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case for the offence registered under Sections 363, 366(A) and 506/34 of the IPC. The prosecution story, in brief, is that on 23/24.05.2019, Deepak Kumar, Devendra Paswan (petitioner), Harendra Kumar and five other unknown persons kidnapped the minor daughter, aged about 14 years, student of 9th Class of the informant. Deepak Kumar (petitioner) and Harendra Kumar pursuaded his daughter and holding threat to come with them otherwise the victim and her father will be done to death. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 25.05.2019. The petitioner has got no criminal antecedent. The
Patna High Court CR. MISC. No.64028 of 2019(2) dt.22-10-2019 2/2 petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The victim has been recovered and her statement under Section 164 of Cr. P.C. has been recorded. She has not supported the allegation made in the F.I.R. She has left her house out of her own will.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- III (West), Muzaffarpur, in connection with Kudhani P.S. Case No. 339 of 2019, G.R. No. 1675 of 2019.
