Petitioner prays for bail in connection with Hulashganj P.S.Case No. 46 of 2015 registered for the offences punishable under Sections 384 of the Indian Penal Code and 17 of C.L.A. Act.
Allegation against the petitioner is of demanding 10% profit of contract and petitioner is not named in the FIR and later on his name transpires in the confessional statement of co-accused Anil Yadav.
Submission of learned counsel for the petitioner is that on the basis of the confessional statement he has been made accused in other cases also and he is on bail in all those cases and he is in custody since 25.7.2018 and co-accused Anil Yadav, in whose confession name of petitioner has come, has been granted bail vide
Patna High Court Cr.Misc. No.60719 of 2018 (2) dt.06-10-2018 2/2 order dated 1.10.2015 passed in Cr.Misc.No. 46434 of 2015 by a co-ordinate Bench of this Court and another co-accused has been granted bail vide order dated 10.9.2018 passed in Cr.Misc.No. 37775 of 2018 by co-ordinate Bench of this Court. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Hulashganj P.S.Case No. 46 of 2015, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
