2. Petitioner is apprehending his arrest in connection with Delha P.S. Case No. 133 of 2024, registered for the offence punishable u/s 8(c), 21(a) and 29 of the N.D.P.S. Act.

3. As per prosecution case, co-accused Shashikant Sagar @ Badshah has been arrested on the spot carrying 5.5 gram Heroin who disclosed the name of this petitioner.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. Further submission is that no incriminating article has been recovered from the conscious possession of the petitioner. Petitioner has been made accused in this case merely on the confessional statement of co-accused Shashikant Sagar @

Patna High Court CR. MISC. No.78271 of 2024(2) dt.21-11-2024 2/2 Badshah. Petitioner has got one criminal antecedent of Excise Act.

5. Learned APP for the State opposed the prayer for bail by contending that petitioner is named in the FIR who is said to be indulged in trading of illegal contraband.

6. Considering the nature of accusation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. (Anjani Kumar Sharan, J) utkarsh/- U T
