JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barachatti P.S. Case No. 310 of 2014 instituted for the offence under Sections 370, 371, 323, 379, 504/34 and 120(B)/34 of the Indian Penal Code. It is alleged in the written report that in the year 2009, petitioner along with other accused person, took away two sons of the informant on the pretext to get them employment, but they did not return. The informant inquired from petitioner then he always made promise to return his sons. One son of the informant was recovered by the police. He has given statement under Section 164 Cr. P.C. wherein he has not taken the name of this petitioner. He has stated in his statement that he was taken by Virendra for employment. His brother has been shifted to Delhi.

Counsel for the petitioner has submitted that it has come to the knowledge of the petitioner that elder son of the informant was shifted from Himachal Pradesh to Delhi along with employer, Pema Wangchun and then again went back to Himachal Pradesh. Copy of verification details of the employer of second son has been enclosed as Annexure-2. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati (Gaya) in connection with Barachatti P.S. Case No. 310 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner.
