1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Tajpur Police Station Case No. 119 of 2025, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2022.

3. As per the prosecution case, police, on 23.07.2025, got the secret information that illicit liquor was being transported through a vehicle. The police intercepted the bolero pick-up vehicle and recovered 1240.92 liters of foreign liquor and arrested two persons and two to three persons succeeded in fleeing away.

4. Learned Counsel for the petitioner submits that the petitioner has been made accused merely because he happens to be the registered owner of the vehicle in question. The vehicle is commercial vehicle and was being plied on hire basis. The vehicle was entrusted for transportation of goods to the driver and co-driver and the petitioner was not aware that the vehicle was being used for illegal purpose of transportation of liquor. The co-driver and the driver were arrested on the spot. Petitioner is having no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner and the petitioner is having no criminal antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-II, Samastipur, in connection with Tajpur Police Station Case No. 119 of 2025, subject to the condition laid down under
