The petitioner seeks bail in a case registered under Sections 341, 307, 506 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
After departure of one Surendra Chaudhary, on disclosure by the informant that the bus has already been sent to his house, 2-3 unknown miscreants resorted firing upon him. They also labbed bomb inflicting fire arm injury to him. When one Sujeet Kumar paid visit at the hotel of Shravan Chaudhary, some occurrence took place.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has no
Patna High Court CR. MISC. No.69038 of 2019(2) dt.04-12-2019 2/2 concern with the aforesaid occurrence. He has been falsely implicated in the case due to dirty village politics. There is nothing cogent on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused namely Chandan Kumar and Om Prakash recorded before the police which have no evidentiary value in the eye of law. Said Om Prakash Mahto and co-accused Surendra Chaudahry have been enlarged on bail by different coordinate Benches of this Court while Sujit Kumar has been enlarged on anticipatory bail by a co-ordinate Bench of this Court. Petitioner has been languishing in custody since 01.06.2019.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Gardhpura P.S. Case No. 20 of 2018.
