2. The petitioner seeks pre-arrest bail in connection with Bagaha P.S. Case No. 419 of 2023 dated 14.06.2023 registered for the offence(s) punishable under Sections 420, 406/34 of the Indian Penal Code.
3. As per the allegation made in the FIR, a sum of Rs.1,12,92,320/- has been defalcated.
4. Learned counsel appearing on behalf of the petitioner submitted that there is allegation of misappropriation, but such a large scale of misappropriation of money cannot take place without there being an organized gang and petitioner
Patna High Court CR. MISC. No.75227 of 2023(2) dt.29-11-2023 2/2 cannot be solely held responsible for such defalcation. It is further submitted that the said money belongs to 292 customers.
5. Considering the nature of allegation, as well as, the manner, in which the accused persons, named in the FIR, have defalcated the public money belonging to 292 customers, which requires a thorough investigation, I am not inclined to grant prearrest bail to the petitioner.
6. Petitioner may approach the District Court, if he undertakes to deposit a sum of rupees fifty lacs and then in that case, the District Court may enlarge the petitioner on regular bail on such terms and conditions as the court below deems it fit and proper.

With aforesaid observations, the present application stands disposed of.
