JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Haspura P.S. Case No. 93 of 2019 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Petitioners are named in the first information report but the first information report goes to show that deceased had sweet relation with daughter of F.I.R named accused Kalam Sah and allegedly, the deceased went to the house of aforesaid Kalam Sah in the night of alleged occurrence on the invitation of daughter of Kalam Sah. So far as petitioners are concerned,
Patna High Court CR. MISC. No.66658 of 2019(32) dt.05-03-2020 2/2 petitioner no. 1 happens to be uncle and petitioner no. 2 is grandfather of daughter of informant.
Moreover, after perusal of entire case diary I find that except suspicion, there is nothing against the petitioners. Accordingly, let above named, petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in Haspura P. S. Case No.93 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C. N.K/- (Hemant Kumar Srivastava, J) U T
