The petitioners seek anticipatory bail in a case instituted for the offences under Sections 452, 302, 307, 324, 323, 147 and 379 of the Indian Penal Code.
Allegation has been made that accused persons came with various arms and entered into the house of the informant, whereupon Ghanshyam Yadav exhorted to catch Binod and kill him today, whereupon they caught hold Binod and whereafter Kundan Yadav and Chandan Yadav who were armed with Khanti and rod assaulted on the head of Binod. When he felled down even thereafter they have assaulted with Lathi Danta indiscriminately.
Patna High Court Cr.Misc. No.59391 of 2018 (2) dt.08-10-2018 2 /2 Allegation against the petitioners is that they have not assaulted but snatched away the money.
Looking to the facts and circumstance, the petitioners being ladies and having no any overact in the matter of assault of Binod, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Dhaniya Devi and Reena Devi @ Chandani Devi, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Asarganj P.S. Case No.34 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) Vinay/Sunny U T
