The petitioner seeks bail in connection with Naokothi P.S. Case No. 37 of 2019 registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code. The prosecution case, in short, is that the sister of the informant Mamta Devi was married to one Nitish Choudhary, the son of the petitioner two years ago, Since the date of marriage, Nitish Choudhary as well as Rabindra Choudhary along with other family members used to pressurize the family of Mamta Devi for demand of dowry and lastly due to nonfulfillment of dowry demand, she was allegedly killed by inlaws family and her dead body was got dis-appeared.
Patna High Court CR. MISC. No.65588 of 2019(2) dt.05-11-2019 2/3 Learned counsel for the petitioner further submits that the petitioner is in jail custody since 01.08.2019. Petitioner is the father-in-law of the deceased. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent and only the charge sheet has been submitted. There is no allegation of tampering of the witnesses. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rajeev Ranjan, J.M 1st Class, Begusarai in connection with Naokothi P.S. Case No. 37 of 2019, subject to the following conditions :
(1) One of the bairlors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the
