The petitioners are in custody since 09.08.2018 in connection with Excise Spl. Case No. 935 of 2018 arising out of Fulkaha P.S. Case No. 142 of 2018 for the offence registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioners but on suspicion the present petitioners were implicated in the present case. It has been further submitted that they have no criminal antecedent.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.57789 of 2018(2) dt.20-09-2018 2/2 the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge cum Special Judge, Araria, in connection with Excise Spl.
