The petitioner seeks bail in anticipation of his arrest in connection with Sakri P.S. Case No. 82 of 2018 dated 11.06.2018 instituted for the offences under Sections 147, 149, 341, 323, 504 and 506 of the Indian Penal Code.
During the course of measurement of land, an occurrence is said to have taken place in which the petitioner is alleged to have assaulted the elder brother of the husband of the informant. It is also alleged that the petitioner along with his wife have misbehaved with the wife of the informant.
Learned counsel appearing for the petitioner has submitted that the injury suffered by the brother of
Patna High Court Cr.Misc. No.57776 of 2018(2) dt.11-12-2018 2/2 the husband of the informant is simple in nature and that the allegation of outraging the modesty of the informant cannot be accepted as the petitioner was all through accompanied by his wife.
The petitioner does not have any criminal antecedent.
Regard being had to the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Sakri P.S. Case No. 82 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
