ANJANA MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.07.2018 in connection with Nawanagar (Basudewa) P.S. Case No.48 of 2018 registered for the offence under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because the petitioner has got several criminal antecedents, he was remanded in connection with the present case. It is further submitted that subsequent to his confession, no recovery has been made from the possession of the petitioner and the petitioner undertakes to abide by the terms and conditions as imposed by this Court, if extended the privilege of bail. It is further submitted that

Patna High Court Cr.Misc. No.59449 of 2018(2) dt.28-09-2018 2/3 the recovery of pick-up van was not from his possession and till date, he has not been placed on T.I. Parade. Learned counsel appearing on behalf of the State submits that it appears from the case diary that there is some materials against the petitioner but there is no recovery of the alleged stolen vehicle from the petitioner. Considering the aforementioned facts and circumstances and in view of the fact that there was no recovery of the stolen vehicle from his possession, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Nawanagar (Basudewa) P.S. Case No.48 of 2018, subject to the following conditions:

(1) One of the bailors will be his own blood relative, namely, mother, brother, son, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) PNM U T
