The petitioner seeks regular bail in connection with Alamganj P.S. Case No. 769 of 2021, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

The case of the prosecution, in brief, is that 35 litres of illicit liquor is alleged to have been recovered from the house of the petitioner, upon raid having been conducted by the officials.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he

The learned counsel for the petitioner further submits that the petitioner has already been sufficiently punished on account of his incarceration, hence a sympathetic view be taken and the petitioner be granted the privilege of bail. 5.

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the period of incarceration of the petitioner herein as also considering the fact that he is having a clean antecedent, I deem it fit and proper to admit the petitioner to the privilege of regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge
