JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420,406,409/34 of the Indian Penal Code.

The accusation against petitioner is that she along with other accused transferred Rs. Five lac in the account of Dada Enterprises for purchasing cement under Nal Jal Scheme. However, learned counsel for the petitioner submits that petitioner had already deposited aforesaid amount with concerned department and moreover, the above stated fact does not make the offence of misappropriation of government fund. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount
