2. The petitioner seeks regular bail in connection with Sessions Trial No. 617 of 2023, arising out of Baikunthpur P.S. Case No. 113 of 2023 for the offences registered under Sections 398/401 of the Indian Penal Code and Sections 25(1-b)A, 26-1, 35 of the Arms Act.
3. As per the prosecution case, on getting information of gathering of some miscreants near a diversion at Satarghat Bride to Faijullahpur village road for committing loot, informant/ S.H.O. reached there. Seeing the police party, accused persons started fleeing away but on chase petitioner and one Ripujay Kumar Singh @ Ripu were caught. It is alleged that from possession of the petitioner one country made pistol, two live cartridges and a knife were recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He was not found committing any offence. Petitioner has two criminal antecedents. Charge-sheet has already been submitted. There is no chance of tampering with the evidence or absconding of the petitioner. It is further submitted that similarly situated co-accused, namely, Ripujai Kumar Singh @ Ripujai Singh @ Ripu has already been granted bail by a Co-ordinate Bench of this Court, vide order dated 06.11.2023 passed in Cr. Misc. No. 69679 of 2023.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Baikunthpur P.S.
