The petitioner seeks bail in Jalalpur P.S. Case No.77 of 2018, registered under Sections 399 and 402 of the Indian Penal Code and under Sections 25(1-b) a/26/35 of the Arms Act. The police after having received information that some criminals had assembled for committing cognizable offence raided the place and arrested the petitioner and others. From the possession of two accused persons, namely, Rakesh Kumar and Rajesh Kumar Kushwaha loaded country made pistols were recovered. From the possession of the petitioner, one Samsung mobile was recovered. From other accused persons mobiles were recovered.
The learned counsel for the petitioner submits that the petitioner is an accused in Baniyapur P.S. Case No.63 of 2018,
Patna High Court Cr.Misc. No.58603 of 2018(2) dt.20-09-2018 2/2 registered under Section 379 of the Indian Penal Code. No other criminal case is pending against the petitioner and the petitioner is in jail since 05.05.2018.
Having considered the facts that the petitioner was arrested along with other accused persons on the allegation that petitioner was preparing to commit offence but only mobile was recovered from the possession of the petitioner and he is in jail since 05.05.2018, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IX, Saran in connection with Jalalpur P.S. Case No.77 of 2018.
