JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 28.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hilsa P. S. case no. 638/2017 registered under sections 147, 148, 149, 353, 307, 332, 333, 186, 187,115,153(B), 295(A), 341, 120(B) and 325 of the IPC.

The petitioner is not named in the first information report though several persons are named in the first information report.

However, learned counsel for the petitioner submits that one co-accused Rajesh Kumar@Pataniya@ Patanahiya has already been admitted to anticipatory bail by a

Patna High Court Cr.Misc. No.59253 of 2018 (2) dt.28-09-2018 coordinate bench of this court vide order dated 08.08.2018 passed in Cr. Misc. no. 44956/2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Hilsa, Nalanda in Hilsa P. S. case no. 638/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
