Petitioner seeks bail in Pirbahore P.S. Case No.322 of 2018 instituted for the offence under Section(s) 447, 341, 323, 427, 307/34 Indian Penal Code and Section 4 of the Explosive substance Act.
Counsel for the petitioner submits that the other coaccused with similar allegation has already been granted bail by co-ordinate Bench of this Court vide order dated 28.09.2018 passed in Cr. Misc. No.59479 of 2018.
In the written report, it is alleged that informant identified through camera the petitioner and other accused persons throwing explosive substance near the door of the
Patna High Court Cr.Misc. No.56581 of 2018 (2) dt.04-10-2018 2/2 informant. From the written report itself, it appears that no one sustained any injury.
Petitioner is said to be in custody since 26.06.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No.322 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
