The petitioner seeks regular bail in connection with Gopalpur P.S. Case No.203 of 2018 registered for the offences punishable under Sections 385 and 387 of the Indian Penal Code. It is alleged that someone threatened the informant on his mobile to pay ransom of Rs.10 lacs.
It has been submitted that the petitioner is not named in the F.I.R. The name of this petitioner appeared in confession of other co-accused Kundan Kumar Sharma. Nothing has been recovered from possession of the petitioner. The petitioner is running a mobile repairing shop from where he sold a mobile phone and SIM to one Sachin Kumar. Patna High Court Cr.Misc. No.58786 of 2018 (2) dt.06-10-2018 been allowed bail by one of the coordinate bench of this court in Cr.Misc.No.53471 of 2018. The case of this petitioner stands on similar footing. He is in custody since 13.06.2018 having clean antecedent and so he deserves bail.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M. 1st, Naugachia, Bhagalpur in connection with Gopalpur P.S.
