Petitioner, who is in custody, seeks bail in connection with Chainpur P.S. Case No. 216 of 2018 in Excise Case No. 719 of 2018, registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Informant who is the police officer has stated that when he was on patrolling duty with other police personnel one Indigo car was stopped in which 5 accused persons were sitting and on seeing police party, three fled away and two were apprehended at the spot and thereafter total 230 pieces of bottles of illegal wine containing 180 ml. each was recovered from the said vehicle.
Patna High Court Cr.Misc. No.59943 of 2018(2) dt.05-10-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. No incriminating articles has been recovered from the possession of the petitioner. Petitioner is an old man aged about 65 years. He has no criminal antecedent and is in custody since 12.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Kaimur at Bhabua in Excise Case No. 719 of 2018, in connection with Chainpur P.S. Case No. 216 of 2018.
