The petitioner seeks bail in connection with N.D.P.S.Case No.41 of 2019, arising out of Raushanganj (Bankebazar) P.S. Case No.75 of 2019, registered for the offence under Sections 15/18 of the N.D.P.S.Act. Accusation is that on secret information about carrying huge quantity of DODA by Arjun Yadav, Bishundeo Yadav and Dharamdeo Yadav (the petitioner) through a bus, the informant with raiding team including Anchaladhikari, reached to the road and stopped a bus coming from western side. On search, two persons, named as Arjun Yadav and Dharamdeo Yadav, disclosed that their third associate Vishun Yadav had got

Patna High Court CR. MISC. No.67418 of 2019(2) dt.27-11-2019 2/2 down from the bus in the way. On their disclosure, five bags filled up with 19 Kg. Doda and 19 Kg. Catechu in five bags recovered from the dickey of the Bus.

Submission is that the petitioner has been made accused on the basis of mere suspicion and he has no concern with the alleged seized contraband. Further submission is that the petitioner has no criminal history and he is in custody since 03.05.2019.

Having considered the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned learned Sessions Judge-cum-Special Judge( N.D.P.S. Act), Gaya in connection with N.D.P.S.Case No.41 of 2019, arising out of Raushanganj P.S. Case No.75 of 2019.
