The petitioner seeks bail in Kathaiya P.S. case No. 82 of 2018 registered under Section 413, 414, 412, 120B/34 of the Indian Penal Code and under Section 15 (1-B) A/26, 35 of Arms Act.

The informant, a police official, got information that a loaded truck is parked near the road and some persons were unloading articles from the truck. The informant got information that the accused persons have brought the truck after committing dacoity. Two persons were apprehended who disclosed their names as Om Prakash @ Om Prakash Jha and Deepak Ranjan @ Radheshyam. Arms and ammunition were recovered from the apprehended accused and they disclosed the name of petitioner.

No.58590 of 2018 (2) dt.20-09-2018 2/2 The learned counsel for the petitioner submits that petitioner was not apprehended on the spot and nothing has been recovered from the possession of the petitioner. Similarly situated accused Vikash Kumar has already been granted anticipatory bail. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II (West), Muzaffarpur in connection with Kathaiya P.S. case No. 82 of 2018.
