This is a case of misuse of privilege of bail. Learned counsel appearing for the petitioners submits that petitioners were granted bail by this Hon'ble Court vide orders contained in Annexure-2 (series), however since they had gone out of the State for earning the livelihood, they could not make proper pairvi in the case. On getting information about the cancellation of their bail bonds, they immediately surrendered before the Court below. Petitioners undertake to co-operate in the trial. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.68672 of 2019(2) dt.06-11-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addiitonal Sessions Judge-cum-F.T.C. II, Katihar in connection with Sessions Trial No. 310 of 2005 arising out of Azamnagar (Salmari O.P.) P.S. Case No. 20 of 2005 with condition that petitioners shall appear on each and every date fixed in the trial and in case petitioners fail to appear on two consecutive dates without prior permission of the Court concerned, the Court below shall be at liberty to take steps for cancellation of their bail bonds.
