The petitioner seeks bail in a case registered for offences punishable under sections 30 (a), 34 and 38 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 150 litres of foreign liquor was recovered from the bushes near canal and after seeing the police party the petitioner and other four persons were trying to escape from the scene. It is contended that nothing has been recovered from the conscious possession of the petitioner and he has been falsely implicated on suspicion. It is also contended that co-accused, namely, Suraj Kumar and Pintu Kumar have been granted bail vide order dated 28.9.2018 passed in Cr. Misc. No. 57870 of 2018 by a co-

Patna High Court Cr.Misc. No.58958 of 2018(2) dt.06-10-2018 2/2 ordinate Bench of this Court. Petitioner further claims that he is having clean antecedent and is in custody since 18.07.2018. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Rohtas, in connection with Sasaram (M) P.S. Case No. 91 of 2018.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
