JUSTICE SHAILENDRA SINGH ORAL ORDER 15-11-2025 The petitioners apprehend their arrest in connection with Bihariganj P.S. Case No. 184/ 2024 dated 29.05.2024 registered for the offence(s) punishable under Section(s) 323, 324, 379, 307, 504, 506 read with section 34 of the IPC.

2. Heard Mr. Vasant Vikash, learned counsel for the petitioners and Mr. Rajendra Singh Shastri, learned APP for the State.

3. The main submissions advanced by the petitioners' counsel are that the main allegation of assault is against coaccused Md. Anwar, who has been granted anticipatory bail by a co-ordinate bench of this court vide order dated 16.05.2025

Patna High Court CR. MISC. No.68380 of 2025(3) dt.15-11-2025 2/3 passed in Cr. Misc. No. 31406 of 2025, in fact, the wife of petitioner no.1 runs a grocery shop which was looted by the informant of the instant case and her husband Gyan Chandra Mukhiya and during that course the son of petitioner no.1, Md. Anwar was badly assaulted for which wife of the petitioner no.1 lodged Bihariganj P.S. Case No. 182 of 2024 and only thereafter the FIR of the present matter was lodged with malafide intention as well as to create a defence and the injury report of son of petitioner no.1 has been filed with this petition along with his photographs which shows the seriousness of the injuries.

4. Learned APP appearing for the State has opposed the prayer for anticipatory bail of the petitioner.

5. In the facts and circumstances of this case and considering the above stated facts and mainly the petitioners' grounds detailed in paragraph 10, 11 and 13 of the petition, this court is inclined to accept the petitioners' prayer for anticipatory bail. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Bihariganj Case No. 184/ 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with
