Petitioners apprehend their arrest in a case registered for the offence punishable under section 364 of the Indian Penal Code.
As per the allegation, all the FIR named accused persons including these petitioners threatened the informant to shoot him and petitioner no.2 snatched his mobile and injured him.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.68918 of 2022(2) dt.04-04-2023 2/2 case. Petitioners are employees of the factory of the informant and when they demanded their remuneration, informant lodged this false and concocted case. There is delay of two days in lodging the FIR and there is no explanation of delay. No overt act has been alleged against these petitioners. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City under District- Patna in connection with Nadi P.S. Case No. 133 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
