2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 498A of the Indian Penal Code.
3. Petitioner is the husband of opposite party no.2. The prosecution case is based upon a complaint filed by the opposite party no. 2 in which she has made an allegation of demand of dowry and torture.
4. By earlier order, the matter had been sent to the Patna High Court Mediation and Conciliation Centre for resolution of disputes between the parties and mediation report available on record would show that the parties have reached an amicable settlement vide an agreement dated 17.04.2025 in the Mediation Proceeding No. 177 of 2025 whereby an amount
Patna High Court CR. MISC. No.72113 of 2024(4) dt.30-04-2025 2/2 of Rs. 2,50,000/- has been agreed as total settlement amount between the parties. It has further been agreed that before 31st July, 2025, the petitioner would be paying an amount of Rs. 2,50,000/- as full and final settlement to the opposite party no. 2 thought the bank draft.
5. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.1st Madhubani in connection with C.R. No. 749 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
6. It is expected that both the parties would strictly abide to the terms and conditions agreed between them before the Mediation Centre. The opposite party no. 2 will have the liberty to move for cancellation of bail before the learned court below in case the terms and conditions of the agreement are violated.
