The petitioner seeks bail in connection with Gangata Police Station Case No. 56 of 2018 registered for offences punishable under sections 121, 121(A), 386, 506, 120B/34 of the Indian Penal Code and 16, 17, 18, 19, 20, 21 and 22 of UAP Act. As per FIR, two unknown persons came on a motor cycle and handed over a letter to the guard of informant wherein demand of Rs.2,00,000/- was made in the name of naxalite. It has been submitted that the petitioner has no concern with any extremist or Naxal. He is a handicapped person from both legs and is unable to even move freely. The petitioner is not named in FIR. The name of this petitioner transpired on
Patna High Court Cr.Misc. No.58913 of 2018 (2) dt.06-10-2018 2/2 confessional statement of co-accused Rabindra Kumar. He is neither a member of any extremist nor he was put on T.I.P. He is in custody since 28.05.2018.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Munger in connection with Gangata Police Station Case No. 56 of 2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
