JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-10-2019 Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition filed on behalf of Anjum Ara (petitioner no.2) and Shabnam Ara (petitioner no.3) as they have already been arrested.

Patna High Court CR. MISC. No.67151 of 2019(2) dt.24-10-2019 2/3 Ara (petitioner no.2) and Shabnam Ara (petitioner no.3) is dismissed as has become infructuous.

Heard both sides.

Petitioners apprehend their arrest in Ramnagar P.S. Case No.127 of 2019 registered under Sections 498A and 34 of the Indian Penal Code and under sections 3 and 4 of the Dowry Prohibition Act.

The informant lodged the case against her husband and other in-laws alleging that they all subjected her to all sorts of torture and when the informant did not agree to execute the sale deed with regard to the land, all accused persons made an attempt to kill her.

Learned counsel for the petitioners submits that the petitioners are in-laws of the informant. The petitioners never demanded any dowry nor tortured the informant. The petitioners, of course, are named in the F.I.R. but the informant did not make any specific allegation against the petitioners. Having considered the facts and the nature of allegation made against the petitioners and the fact that the petitioners are in-laws of the informant, petitioner nos.1 and 4 to 8 named above, in the event of their arrest or surrender before the learned court below within a period of four weeks from the

No.67151 of 2019(2) dt.24-10-2019 3/3 date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bagaha, West Champaran in connection with Ramnagar P.S. Case No.127 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
