JUSTICE RAJESH KUMAR VERMA ORAL ORDER 07-05-2025 Heard Mr. Rajiv Kumar Singh, learned senior counsel for the petitioner and Mr. Nand Kishore Prasad, learned Additional Public Prosecutor for the State.
2. The petitioner is apprehending his arrest in connection with Turkauliya (Motihari) P.S. Case No. 320 of 2024, F.I.R. dated 13.07.2024 for the offences punishable under Sections 106 and 281 of the Bhartiya Nyay Sanhita, 2023.
3. As per the First Information Report, when the father of the informant reached Semra Hospital Chowk, one bolero pickup vehicle coming at high speed was rashly driven came from Chhapwa side and hit his father due to which his father fell down on the road and became injured.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.73366 of 2024(5) dt.07-05-2025 2/2 petitioner has clean antecedent and he has falsely been implicated in the present case. As per allegation in the FIR petitioner is the driver of the vehicle in question and he fled away from the place of occurrence. He further submits that the police has submitted charge sheet under Section 106 and 281 Bharatiya Nyay Sanhita and Section 106(2) is still not notified by the Government of India. He further submits that pursuant to the direction of this Court vide order dated 11.11.2024, the petitioner has surrendered before the learned Court below.
5. The provisional bail granted to the petitioner vide order dated 11.11.2024 is hereby confirmed.
