JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Babubarhi P.S. Case No. 29/2019, disclosing offences under Sections 420, 406 and 506 of the Indian Penal Code. Prosecution case is that petitioner has taken Rs. 24 thousand from the informant for making pairvi before the SDPO and when the informant went to the SDPO, the petitioner was not there and when she demanded her money back, petitioner said to have abused her and threatened to kill her. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and only vague allegation has been levelled against him and further there is no chit of paper to show that the petitioner has taken any money from the informant.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Madhubani, in connection with Babubarhi P.S. Case No. 29/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
