2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 354, 379, 504, 506/34 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner and one another accused person case at the residence of informant and started to hurl filthy language upon the family members of the informant. On objection being raised, petitioner caught hold the hair locks of the informant and tossed her down on the ground and brutally assaulted her. When her family members came there to rescue her, they were also beaten up by the accused persons.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.75452 of 2023(2) dt.29-11-2023 2/2 that petitioner has been falsely implicated in this case. Doctor opined that injured persons have received simple injury. In fact, there was free fight between the parties and members of both side have received injuries. There is case and counter case. Petitioner is languishing in judicial custody since 17.06.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Dandkhora P.S. Case No. 29 of 2023. (Sunil Kumar Panwar, J) sushma/- U
