The petitioner, who is in custody, seeks bail in connection with Sessions Case No. 167 of 2018 arising out of Khagaria (Mufassil) P.S. Case No. 04 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 324, 307, 353, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Informant is the police official, who in his fardbeyan has stated that on 02.01.2017 at 22.00 hours in the night he received information that notorious criminal Sujay Singh @ Fighter (petitioner) alongwith 7-8 associates have assembled near a temple in order to commit some heinous crime. On seeing informant alongwith other police personnel the
Patna High Court Cr.Misc. No.59154 of 2018(2) dt.09-10-2018 2/2 accused persons started fleeing away and also fired upon the police in which informant sustained firearm injury but all the accused managed to flee away taking advantage of darkness. It has been submitted on behalf of the petitioner that similarly situated co-accused persons, namely, Ranvir Sahni, Balvir Sahni and Ranjeet Kumar have been granted bail by a different co-ordinate Bench of this Court vide order dated 17.10.2017, 12.01.2018 and 25.06.2018 passed in Cr. Misc. No. 45579 of 2017, Cr. Misc. No. 59028 of 2017 and Cr. Misc. No. 23073 of 2018. Petitioner is in custody since 29.06.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Khagaria, in connection with Sessions Case No. 167 of 2018 arising out of Khagaria (Mufassil) P.S. Case No. 04 of 2017.
