The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 of the Indian Penal Code, section 27 of the Arms Act and section 3/4 of the Prevention of Witchcraft Practices Act. As per the prosecution case, on the alleged date and time of occurrence, the grand-daughter of the informant informed him that this petitioner fired upon the back of his wife. Thereafter, informant went at the place of occurrence, where his wife informed him that this petitioner fired upon her. Thereafter, Informant took his wife to the hospital for treatment. It is submitted that petitioner is innocent and he has been falsely implicated in this case due to village politics. Petitioner claims clean antecedents.

Patna High Court CR. MISC. No.1873 of 2023(4) dt.03-07-2023 2/2 Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Banka P.S. Case No. 520 of 2021. Accordingly, the same is rejected.
