2. The petitioner is in custody in connection with Sultanganj P.S Case No. 129 of 2021 registered for the offences punishable under Sections 147, 148, 149, 447, 354(A), 307, 386 and 506 of the I.P.C and 27 of the Arms Act.
3. As per prosecution case, petitioner along with co-accused have killed the husband of the informant and also misfired bullet on the informant.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is
Patna High Court CR. MISC. No.70332 of 2025(2) dt.08-10-2025 2/3 further submitted that nothing is mentioned about demand of extortion in FIR in-spite of that Section 386 of the I.P.C added in this case. It is also submitted that petitioner is in judicial custody since 27.02.2025
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, impugned order and materials available on reocrd, it appears that Co-accused has already granted anticipatory bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 53037 of 2025 vide order dated 13.08.2025. Investigation of this case is already concluded accordingly chargesheet submitted. No injury is caused upon the body of the informant.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Patna City in connection with Sultanganj P.S Case No. 129 of 2021, subject to the condition that petitioner shall physically present each and
