2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 406 and 420 of BNS. 3 . The prosecution case , in brief, is that this petitioner entered into an agreement to sell a piece of land to the complainant on 24.06.2018 and accordingly, on 30.06.2018, an

The petitioner signed an undertaking in front of the witnesses on a stamp paper and handed over the same to the complainant. The complainant time and again requested the petitioner to execute the sale deed after paying the due consideration money but petitioner refused to do so.

4. It is submitted on behalf of the petitioners that due to intervention of well wishers, the dispute between both the parties has been resolved and they have mutually agree to withdraw the present dispute . However, petitioner has already paid the entire amount of Rs. 5 lakhs to the Opposite party No. 2.

5 . Learned counsel for the State as well as Opposite party No. 2 does not dispute the contention made on behalf of petitioner.

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - I Bikramganj Rohtas in connection
