Petitioner seeks bail in Sikandra P.S. Case No.152 of 2018 instituted for the offence under Section(s) 147, 148, 149, 302, 120(B) Indian Penal Code and 27 of the Arms Act. Counsel for the petitioner submits that there is no any specific allegation of overt act against the petitioner. In the written report, there is specific allegation against co-accused Krishnadev Ravidas of assaulting Valmiki Yadav, and against Vinod Mahto of firing on Valmiki Yadav due to which he died on the spot. Petitioner is said to be in custody since 10.07.2018.

It is mentioned in para 3 to the bail application that

Patna High Court Cr.Misc. No.59334 of 2018 (2) dt.06-10-2018 2/2 he has clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jamui, in connection with Sikandra P.S. Case No.152 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
