2. The petitioner seeks bail in a case registered for the offence under Sections 30(a) & 38 and 41 of Bihar Prohibition and Excise (Amendment) Act, 2016.

3. As per F.I.R., 412 litres of country made liquor was recovered from an open place.

4. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of this petitioner and the petitioner has got no concern with the seized liquor. Petitioner is in custody since 07.08.2025. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner has got one

Patna High Court CR. MISC. No.69272 of 2025(3) dt.02-12-2025 2/2 criminal antecedent of similar nature.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise, Barh (Patna) in connection with Special Case No. 2192/2019, arising out of Barh P.S. Case No. 104 of 2019.
