The petitioner apprehends his arrest in connection with Khijarsarai P.S. Case No.102 of 2015 registered under Section 395 of the Indian Penal Code, pending in the court of the Additional Chief Judicial Magistrate, Gaya. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant, the present case was instituted against 6 unknown. In course of investigation, one Pawan Kumar was apprehended, who disclosed the name of the petitioner indulged in the present case.

The F.I.R. indicates that the informant has detailed

Patna High Court CR. MISC. No.64438 of 2019(2) dt.04-11-2019 2/2 about the physique of the culprits involved in the present case. As such, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
