====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-07-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for State through video conferencing.

Petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 123/2019 registered for the offences under Sections 419, 338, 269, 270, 468, 188, 120-B and 420 of the Indian Penal Code.

The accusation against the petitioner is that he was running medical clinic illegally and when his clinic was raided, five patients were found admitted in the aforesaid clinic. Submission on behalf of petitioner is that petitioner does not have any clinic nor petitioner is a doctor and as a matter of fact petitioner runs a shop in the house of one Bablu Singh with whom petitioner does have some dispute and on account of the aforesaid dispute the petitioner has been implicated in this case by the informant at the behest

He further submits that the Investigation Officer did not record the statement of so called patients who were found admitted in the clinic of the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties let petitioner in the event of his arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 123 of 2019 subject to conditions as laid down under Section 438 (2) of the Cr.P.C.
