====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsels for the petitioner and the State.
Petitioner seeks bail in connection with Itarhi P.S. Case No. 93 of 2017 registered for the offence punishable under sections 304B, 120B and 201/34 of the Indian Penal Code. Petitioner has earlier moved this court for grant of bail in Criminal Misc. No. 48139 of 2017 which was rejected vide order dated 17.10.2017 (Annexure-1) with liberty to the petitioner to renew his prayer for bail if the trial is not taken up within ten months.
Learned counsel appearing for the petitioner submits that the trial of this case is going on in a very slow pace and till date charge has not been framed in this case and petitioner is in
Patna High Court Cr.Misc. No.59272 of 2018(2) dt.08-10-2018 2/2 custody for more than 15 months. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Chief Judicial Magistrate, Buxar in connection with Itarhi P.S. Case No. 93 of 2017.
