The petitioner has preferred this application for grant of regular bail in connection with Giriyak (Katarisarai) P.S. Case No. 88 of 2021 dated 25.02.2021 registered for the offences punishable u/ss 353 and 366A of the Indian Penal Code later on Section 376 (D)(A) of the Indian Penal Code and Sections 4 and 6 of the POCSO Act and Section 5 of the Immoral Traffic (Prevention) Act has been added. As per the prosecution case, the accused persons

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the statement recorded under Section 164 Cr.P.C. of the victim. There is no eye witness in this case. He has further submitted that the victim was in love affair with the co-accused Bablu. The medical board has assessed the age of the victim as 17 to 18 years. He has further submitted that the co-accused person named in the F.I.R. has already been granted bail by the Coordinate Bench vide order dated 11.04.2022 passed in Cr. Misc. No. 61785 of 2021. The petitioner has got clean antecedent as stated in para 3 of the bail petition.

The petitioner is in custody since 19.09.2022. Learned A.P.P. for the State has vehemently opposed the prayer of bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.
