JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Earlier prayer for bail of the petitioner was dismissed twice vide order dated 14.09.2017 passed in Cr. Misc. No. 40852 of 2017 and vide order dated 14.03.2018 passed in Cr. Misc. No. 13169 of 2018 and the allegation against the petitioner is of recovery of two kilograms of charas.

Submission of learned counsel for the petitioner that he has been in judicial custody since 19.12.2016 and four witnesses have been examined during trial and last witness was examined five months ago and since then no progress has been made in the trial.

Heard learned A.P.P. as well as learned counsel appearing on behalf of Union of Indian.

Patna High Court Cr.Misc. No.60230 of 2018 (2) dt.03-10-2018 2/2 Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.

However, since the petitioner has been in custody since 19.12.2016, learned trial court is directed to expedite the trial and conduct the same on day to day basis, without giving unnecessary adjournments so that the trial be concluded expeditiously.
