JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 The petitioner is apprehending his arrest in connection with Nawada P.S. Case No. 232 of 2016, registered for offences punishable under Sections 406, 409, 420, 120(B), 467, 468 and 471 of the IPC.

Allegation against the petitioner, who is a Deputy Manager at S.B.I., Nawada is that he in connivance with District Welfare Officer misappropriated an amount of Rs. 14,33,240.00. It has been submitted on behalf of the petitioner that the cheques were issued by the District Welfare Officer, who has already been granted the privilege of anticipatory bail vide order dated 30.08.2016 passed in Cr.Misc. No. 30055 of 2016. Moreover, the money has already been deposited, which will appear from Annexure - 5 series.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender within a period of six weeks before the court below and the court below after verifying the submission of learned counsel for the petitioner that the entire defalcated money has been deposited and if the submission is found to be true, he shall release the petitioner on bail to his own satisfaction and till verification of the above submission of learned counsel for the petitioner, he shall be released on provisional bail by the concerned court below.
