The petitioner seeks regular bail in connection with L.N.M.U. P.S.case no.48 of 2004 registered for offences punishable under Sections 379, 411/34 of the Indian Penal Code.
This case is about misuse of the privilege of the bail and it appears that the petitioner left pairvi in the year, 2006 after obtaining bail and thereafter he was declared absconder and he has been arrested on 4.6.2018 and since then he is in custody.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner,
Patna High Court Cr.Misc. No.65861 of 2018(2) dt.26-11-2018 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VII, Darbhanga in connection with L.N.M.U. P.s.case nO.48 of 2004 with condition that one of the bailors shall be his family members having sufficient property in the village and further condition that he has to appear in the court as and when required by the court concerned otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
