Mr.Jagdhar Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kawakole (Rupau) P.S. Case No. 157 of 2019, registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is that on receiving information about sustaining injury by several persons in village Nawadih, the informant, Santosh Kumar, along with other police personnel reached there and saw that Rajaram Rajbnshi, Suresh Rajbanshi and Soni Rajabanshi were injured. Thereafter, he sent all injured to P.H.C. for treatment. In course of inquiry, one Mithlesh Yadav, who required in several cases, was apprehended and was taken near the police vehicle, where Sanoj Yadav and Anuj Yadav made protest and started

In the meantime, 24 persons named in the F.I.R. including the petitioners having lathi, danda and bricks in their hand and attacked on the police party to set free to Mithlesh Yadav and also damaged the police vehicles. Learned counsel for the petitioners submits that while the petitioners along with 22 others are named in the F.I.R. but no specific overt act has been attributed against them, in fact, specific allegation has been made against Sanoj Yadav and Anuj Yadav to make protest and started giving threatening of dire consequences.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Nawada, in connection with Kawakole (Rupau) P.S. Case No. 157 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
